This page sets out the Terms and Conditions upon which Marketing Manchester provides the MIPIM 2018 Participation Packages. By submitting the MIPIM registration form you are confirming that you accept these Terms and Conditions and that you agree to comply with them. If you do not agree to these Terms and Conditions, you must not submit the MIPIM registration form. We recommend that you print a copy of these Terms and Conditions for future reference.
These Terms and Conditions apply to the exclusion of any other terms that you seek to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.
1. Request for participation.
(a) The submission of the MIPIM registration form constitutes an offer by you to request participation in MIPIM in accordance with these Terms and Conditions.
(b) The request for participation set out in 1(a) above shall be deemed to be accepted when we issue confirmation in writing that your request for participation has been accepted (“Confirmation”) at which point and on which date the contract for the participation shall come into existence (“Commencement Date”).
(c) No request for participation in MIPIM 2018 shall be deemed to have been accepted by us unless you have accepted the Terms and Conditions by submitting the MIPIM registration form and we have provided the Confirmation. We reserve the right to reject any request for participation.
2. Cost of packages.
The cost of standard participation (excluding VAT, TVA and insurance) shall be: Sponsor £18,000 plus VAT Partner £12,000 plus VAT Associate £6,500 plus VAT
3. Taxes and duties.
All package prices are exclusive of VAT and TVA (French VAT) which will be charged at the prevailing rate.
We will send an invoice to you for the full price of the package you have selected with our Confirmation. Payment in full is due within 7 days of the date of our invoice. No allocation of package rewards will be made to you until we receive the full invoiced amount.
5. Additional charges.
We will invoice you for any additional charges (such as additional delegate fees & accommodation, catering for events, charges incurred for changes to delegate details), we incur on your behalf, which shall be due and payable within 7 days of the date of our invoice. Additional charges that are incurred in currency other than sterling will be invoiced to you in sterling at the exchange rate prevailing at National Westminster Bank plc at the date of invoice.
6. Allocation of packages and rewards.
All packages and rewards will be allocated strictly on a first come, first served basis according to the level of participation you request and receipt of all payments due. If the participation level you have requested is unavailable we will try to contact you as soon as possible and invite you to participate at any other level that still has availability. Due to nature of the MIPIM 2018 event, we reserve the right to make changes to the package features and the rewards available and to substitute alternative rewards of an equivalent value.
You agree to provide us with advertising copy and details of your listing for inclusion on the MIPIM website and Stand presence (where applicable) before the deadline specified in our deadlines. If you fail to meet this deadline your entry in the publicity materials will be cancelled and no credit against the package price will be given.
8. Advertising copy content.
By submitting your advertising copy to us for inclusion in the publicity materials you confirm that its contents are a true and fair statement of the services or facilities provided by you and that it does not contravene the provisions of any applicable law. You also confirm that such advertising copy does not infringe the rights, including any intellectual property rights, of any third party and agree to indemnify us against all costs, expenses and liabilities we incur as a result of any claim for infringement of such rights by any third party.
9. Publication of advertising copy.
We will make all reasonable efforts to ensure the accurate reproduction of the advertising copy supplied by you, however, we will not accept liability for any errors or omissions unless they arise as a direct result of our negligence in which case our liability to you is limited to the cost of the advertising materials irrespective of the participation package price.
Each person attending MIPIM 2018 will remain responsible for the safe custody and keeping of his or her property and we are not liable for any loss or damage to such property.
We will have no liability to you or to any other person for any loss of profit, economic loss or goodwill or for any special, indirect or consequential loss. Nothing in these Terms and Conditions excludes or limits our liability for our fraud or for death or personal injury caused by our negligence.
You shall indemnify us against injury to any persons and any loss of or damage to any property caused by your negligence or that of your employees, agents, subcontractors and / or guests or arising out of or in connection with your participation at MIPIM 2018.
You may make a change to your delegate details provided you notify us in writing of any requested change. If we incur any charges for making your requested change we will invoice such charges to you as an additional charge.
If you cancel your participation in MIPIM 2018 at any time, you must inform us in writing. The full price for participation will be payable in the event that we are unable to reallocate the participation package you have selected to another participant. Whilst we will endeavour to reallocate the package, we will be under no obligation to do so. In all cases a cancellation fee of £1000.00 is payable.
15. Law. These Terms and Conditions shall be governed by and construed in accordance with English law and both parties agree to submit to the non-exclusive jurisdiction of the English courts.
